Datuk Ewon Benedict explained that his resignation was driven by his belief that the Attorney-General’s Chambers (AGC) should not file an appeal regarding the issue of Sabah’s 40% revenue share under the Malaysia Agreement 1963 (MA63).
KOTA KINABALU : – While emotions run high and the desire for immediate justice is understandable, trusting the legal process is essential for achieving lasting constitutional recognition.
While we understand and sympathize with Sabahans’ frustrations regarding the decision made by the High Court concerning Sabah’s 40% entitlement, it is crucial to recognize that Malaysia’s judicial system is designed to handle such disputes through a structured legal framework.
The Federal Court of Malaysia, as the highest judicial authority, issues final and binding rulings on constitutional and significant legal issues.
Once the Federal Court has made its decision, it is unappealable, underscoring the importance of respecting the rule of law and judicial independence.
In this context, the role of the Attorney General of Malaysia is vital.
It is the constitutional and legal duty of the Attorney General to consider whether to appeal the High Court’s ruling,especially if there are significant constitutional questions involved.
Any appeal would be directed to the Federal Court, which alone has the authority to determine the definitive legal standing.
This process highlights the importance of adhering to proper legal channels in resolving constitutional disputes.
Respecting these procedures ensures the integrity of Malaysia’s judiciary and maintains the rule of law.
During this period, we call on Sabahans to exercise patience and steadfastness. While emotions run high and the desire for immediate justice is understandable, trusting the legal process is essential for achieving lasting constitutional recognition.
Patience and unity in the face of frustration will strengthen our collective resolve.
We hope the Attorney General will refrain from appealing the High Court’s decision and will instead enforce the Mandamus order, fulfilling the Federal Government’s constitutional obligations.
However, it remains important to acknowledge the legal framework and processes that guide these actions.
In the meantime, we must continue to seek justice within the rule of law.
The legal process may take time, but it is the most enduring path towards our constitutional rights and recognition. – November 9, 2025
